Chapter 7: Is It Right for You?

Chapter 7 helps Lubbock families wipe out debt and start over, often in just a few months. Here is how it works and who qualifies.

How Chapter 7 Works

Chapter 7 is often called "liquidation" bankruptcy, though most people who file do not lose any property. It wipes out qualifying unsecured debts like credit cards, medical bills, and personal loans. Many cases are completed in three to four months.

Who Qualifies

Who qualifies for Chapter 7 in Texas depends mostly on income. If your household income is below the Texas median for your family size, you likely pass the means test. Earning more does not automatically rule you out.

Texas Bankruptcy Exemptions: What Lubbock Families Can Keep

Many people worry about losing their property when they file. Texas has some of the most generous exemptions in the country. Lubbock residents also benefit from rural acreage rules for property outside city limits.

Homestead Exemption

Texas protects the equity in your primary home with no dollar limit in most cases. If your home sits within city limits, the exemption covers up to 10 acres. For rural property, families can protect up to 200 acres and single adults up to 100 acres. This is one of the strongest homestead protections in the nation. A federal cap may apply if you bought the home within about 40 months of filing.

Vehicle Exemption

Texas protects one motor vehicle for each licensed driver in your household. The vehicle's equity counts toward your personal property limit below, so in most cases your truck stays with you.

Personal Property

You can protect up to $50,000 in personal property as a single filer or $100,000 for a family. This limit covers home furnishings, clothing, your vehicles, and the farm and ranch property below.

Farm and Ranch Property

Many South Plains families earn a living from the land. Texas law lets you keep farming and ranching vehicles and implements, along with the tools and equipment you use for work. Livestock is covered too: up to two horses, mules, or donkeys with a saddle, blanket, and bridle for each, 12 head of cattle, 60 head of other livestock, and 120 fowl.

These items count toward the personal property limit above. Our attorneys can add up your equipment and animals with you before you file.

Retirement Accounts

Tax-qualified retirement plans are generally exempt, including 401(k)s, IRAs, pensions, and profit-sharing plans. In most cases, your retirement savings stay protected.

About 21 to 40 days after you file, you attend the 341 Meeting of Creditors. In the Northern District of Texas, these meetings now happen by Zoom video, so you can join without driving to the courthouse. A trustee runs the meeting, not a judge. You will need a government-issued photo ID and proof of your Social Security number. Most meetings last only a few minutes, and your attorney is with you the whole time.

In a Chapter 7 case, discharge typically comes within 60 to 90 days after the 341 meeting. You walk away with a clean slate and the tools to rebuild.
